THIS STABLE DOES NOT GUARANTEE YOUR SAFETY OF THAT OF YOUR BOARDED HORSE(S)
IT IS HEREBY AGREED TO AS FOLLOWS THAT:
1. DEFINITIONS
“OWNER” shall herein refer to the owner, part-owner, or lessee of the animal which is contracted to be boarded under this agreement.
“HORSE” and “ANIMAL” shall herein refer to all equine species and also to the specific animals to which this agreement refers.
“BOATD” and “BOARDING” shall herein refer to the provision for compensation of daily routine husbandry, food and physical space for animals by a party who does not generally have financial interest in the animal.
“RIDER” shall herein refer to a person who rides a horse mounted or otherwise handles or comes near a horse from the ground.
“I”, “ME”, or “MY” shall herein refer to the OWNER and the parents of legal guardians there of if a minor.
2. AGREEMENT PURPOSE AND CONSIDERATION
At the commencement of this agreement OWNER agrees to pay the sum of $______ per month. In consideration for THIS STABLE undertaking the board of the animal listed under Clause C below. Payment is due one month in advance. For example, May 1-31st board would be due May 1st. If your payment should be later than 7 days after the first of the month your account will be charged and additional $25.00 late charge per horse that is boarded. Stable shall also be entitled to exert a lien against said horse, and the property upon the premises as more further described below, for any amounts due, and shall be entitled to enforce said lien and foreclose its interest against said horse and/or equipment for the amount due in accordance with the laws of the State of North Carolina. If by chance you decide to move your horse to another stable we require a 30 day notice with paid board.

3. DISCLOSURE OF INFORMATION ABOUT HORSES TO BE BOARDED

4. FEE SCHEDULE FOR BOARDING SERVICES AND HORSE TRAINER POLICY
THIS STABLE shall provide OWNER with a fee schedule for boarding services in advance of the signing of this agreement, which shall become a part of this agreement.
Boarding availability will be in reference to a horse that is being trained. Due to the growing volume of our farm we will no longer be able to hold boarding stalls for horses that are in training, for any period longer than three months. For example, if you have two horses boarding and one is at the trainers, we can hold the opening for the horse at the trainer for a maximum of three months. The only way to guarantee the spot is to pay 50% of the board for that month/months that said horse is at the trainers. Double J Farm will only allow three months of the holding policy, after three months have passed. Double J Farm will fill the spot with the next person waiting on our list. I am sure you understand that this in turn takes revenue away from the farm and inhibits our ability to improve the farm and facility.
All Boarding cost and other services are subject to change at the discretion of the farm owners.
5. BOARDED HORSE HEALTH WARRANTY
Each horse to be boarded shall enter the farm free from transmittable diseases and must be effectively wormed, with current immunizations for Tetanus, Rabies, EEE, WEE, Strangles and Influenza. The following up-to-date documents must be presented to THIS STABLE by OWNER prior to the entry onto THIS STABLE’S premises: The original Yellow Slip Negative Coggins Test Is required and Vet. Health Certification is requested.
6. THIS STABLE HAS THE RIGHT TO REFUSE BOARD
THIS STABLE reserves the right to refuse the continuation of board of any horse for any reason, to include but not limited to: animal’s poor health or unsoundness; dangerous propensities, habits and/or vices which THIS STABLE is not equipped to handle; owner’s refusal to obey stable rules at all times or to cooperate with THIS STABLE on reasonable requests relative to the management, welfare, and safety of animals and people on premises; and also in event of discontinuation of the business of boarding horses. In such event, THIS STABLE shall give OWNER 24 hours notice to remove boarded animal from premises. The ONLY exception would be if the stable were to discontinue its business, the STABLE would give the OWNER a 30-day notice. After all fees have been paid in full this agreement is concluded. Failure to pay boarding fees or other charges as due shall also entitle THIS STABLE to immediately terminate this agreement and possibly apply a lien on the horse until account is paid in full.
7. HARD KEEPERS
In the event that a horse becomes a “hard keeper” Double J Farm will do all that is possible to make sure that the horse is properly cared for. Cost the farm incurs will be billed to the owner at cost. So for example, if a hard keeper horse has to ingest more than an average horse, then the owner will be billed for the extra bag of feed that the horse needed to keep his body score. The same goes for, if the horse’s body score begins to fall, Double J Farm or the owner has the right to increase the horse feed and regardless of who makes the decision to increase the horses feed it will be at the owners expense.
We base our boarding fees on what we consider a normal horses feedings. We usually feed hay to pasture boards only in the winter months beginning around the first of November, or after the grass begins to die off. This also depends on what Double J Farm feels the condition of the pastures are, whether the horses are pasture board or stall board and also the needs of the horses are considered. Stall Boarders are fed hay once daily. Should there come a point and the owner feels it is necessary that their horse needs to be fed hay before Double J Farm deems necessary, the owner will be billed to their monthly accounts.
8. IN EVENT OF BOARDED HORSE ILLNESS OR INJURY
Should the horse become sick or injured, THIS STABLE shall attempt to telephone the OWNER immediately. If the OWNER does not immediately inform the stable or they are not reachable by phone, The STABLE shall contact the emergency contact, if they are not reachable, this STABLE reserves the right to take action if the state of the animal’s health requires immediate action, THIS STABLE, is authorized to request the service of a veterinarian of your choice if reachable, if the veterinarian does not respond promptly the STABLE will call their veterinarian of their choice. By signing the contract the OWNER gives permission to the STABLE to give any other attention that appears necessary, up to the amount of $___________ The OWNER shall promptly pay all expenses for all services. If it is requested by the veterinarian or the owner for the horse to stay in a private paddock or stay in the stall to keep from injuring the horse any further, the owner will billed for each additional bale of hay fed to the horse in the summer months or any that is additionally fed in the winter months. (Additional fees may incur on the account for bandage changing, medicines administered, soaking, ect.)
STABLE SHALL ASSUME THAT OWNER DESIRES SURGICAL CARE IF RECOMMENDED BY A VETERINARIAN IN THE EVENT OF COLIC, OR OTHER LIFE-THREATENING ILLNESS, UNLESS STABLE IS INSTRUCTED HEREIN OR ON OWNER'S INFORMATION SHEETS, BY OWNER THAT THE HORSE(S) IS/ARE NOT SURGICAL CANDIDATES.

OWNER INFORMATION- Owner agrees to notify Stable of any and all change of addresses, emergency telephone numbers, itineraries or other information reasonably necessary to contact Owner in the event of an emergency. In the event Owner departs for vacation or is otherwise unavailable, prior to departure Owner shall notify Stable as to what party is authorized to make decisions in the Owner's place with regard to the health, well being, and/or medical treatment of the horse(s).
9. RULES AND REGULATIONS
The Owner agrees to abide by all the rules and regulations of the Stable. Barn Rules are posted in the barn aisle and on the website.
10. VISITOR PERMISSION TO HANDLE HORSE
In the event someone other than the OWNER and/or his family members want to visit the boarded horse at THIS STABLE such parties shall have written permission or other agreement upon prearranged permission to handle, or ride boarded horse. The visitors must check in with the barn manager once they come upon the premises. They must sign a consent waiver before handling the horses.
11. OWNER ACCEPTANCE OF RESPONSIBILITY OWNER
Has inspected THIS STABLE’S premises and/or has in some other way satisfied himself that the condition of the premises and the facilities will provide an adequate and reasonable level of safety for OWNER’S horse and OWNER, OWNER’S family, guests, and visitors who enter the premises. OWNER agrees to be responsible for any and all damages, injuries, and loss of life caused by the animal while on the premises of THIS STABLE.
DURING THE TIME THAT THE HORSE(S) IS/ARE IN CUSTODY OF STABLE, STABLE SHALL NOT BE LIABLE FOR ANY SICKNESS, DISEASE, ESTRAY, THEFT, DEATH OR INJURY WHICH MAY BE SUFFERED BY THE HORSE(S) OR ANY OTHER CAUSE OF ACTION, WHATSOEVER, ARISING OUT OF OR BEING CONNECTED IN ANY WAY WITH THE BOARDING OF SAID HORSE(S), EXCEPT IN THE EVENT OF NEGLIGENCE ON THE PART OF STABLE, ITS AGENTS, AND/OR EMPLOYEES
IN NO EVENT SHALL STABLE BE HELD LIABLE TO OWNER FOR EQUINE DEATH OR INJURY IN AN AMOUNT IN EXCESS OF TWO THOUSAND FIVE HUNDRED DOLLARS ($2,500). OWNER AGREES TO OBTAIN EQUINE INSURANCE FOR ANY ANIMALS VALUED IN EXCESS OF TWO THOUSAND FIVE HUNDRED DOLLARS ($2,500), AT OWNER'S EXPENSE, OR FOREGO ANY CLAIM FOR AMOUNTS IN EXCESS OF TWO THOUSAND FIVE HUNDRED DOLLARS ($2,500). OWNER AGREES TO DISCLOSE THIS ENTIRE AGREEMENT TO OWNER'S INSURANCE COMPANY AND PROVIDE STABLE WITH THE COMPANY'S NAME, ADDRESS AND POLICY NUMBER. FAILURE TO DISCLOSE INSURANCE INFORMATION SHALL BE AT OWNER'S RISK AND OWNER WILL RESUME RESPONCIBILITY FOR ANY LOSS OR CLAIM IN EXCESS OF TWO THOUSAND FIVE HUNDRED DOLLARS ($2,500).
You must list what you purchased your horse for on this contract. Although this in some cases may be personal, this must be enclosed for insurance purposes. If at all possible we would like to have a copy of the bill of sale which will constitute that this horse is indeed owned by yourself and this will also list the cost of the horse. In some cases, owner chooses to put added training on the horse, which may increase the cost of the horse’s value. Please list if there were any costs that you inquired while owning this horse.

12. RELEASE OF LIABILITY
In consideration of THIS STABLE undertaking the board and related services under the terms set forth herein. I, the undersigned OWNER do agree to hold harmless and release THIS STABLE, its owners, agents, employees, officers, directors, representatives, assigns, members, owners of premises, affiliated organizations, insurers and other acting on THIS STABLE’S behalf (herein after collectively referred to as “associates”) of all claims, demands, causes of action, and legal liability, whether the same be known or unknown, anticipated or unanticipated, due to THIS STABLE and/or ITS ASSOCIATES ordinary negligence; and I do further agree that except in the of THIS STABLE’S gross negligence and willful and wanton misconduct, I shall not bring any claims, demands, legal actions and causes of action against THIS STABLE and ITS ASSOCIATES as stated above in this clause, for any economic and non-economic losses due to bodily injury, death, property damage, and injury to or loss by death of the boarded animal and/or sustained by me and/or my minor child and/or legal ward in relation to the premises and operation of THIS STABLE, to include being near horses owned by or in the care, custody and control of THIS STABLE whether on or off the premises of THIS STABLE.
13. INHERENT RISKS AND NATURE OF THE HORSE WARNING
Horseback riding and horse driving is classified as RUGGED ADVENTURE RECREATIONAL SPORT ACTIVITY and there are numerous obvious and non-obvious inherent risks always present in such activities despite all safety precautions. No horse is a completely safe horse. Horses are 5 to 15 times larger, 20 to 40 times more powerful and 3 to 4 times faster than a human is. If a rider falls from a horse to ground it will generally be at a distance of 3 ½ to 5 ½ feet and the impact may result in injury to the rider. Horseback riding/horse driving is the only sport where one much smaller, weaker predator animal, the human, tries to control and become one unit of movement with another much larger, stronger prey animal, the horse, with each having a limited understanding of the other. If a horse is frightened or provoked it may divert from it’s training and act according to its natural survival instincts which may include but are not limited to: stopping short, changing direction or speed at will; shifting its weight from side to side, bucking, rearing; biting, kicking or running from danger.
The undersigned acknowledges there are inherent risks associated with equine activities such as described below, and hereby expressly assumes all risks associated with participating in such activities. The inherent risks include, but are not limited to the propensity of equines to behave in ways such as, running, bucking, biting, kicking, shying, stumbling, rearing, falling or stepping on, that may result in an injury, harm or death to persons on or around them; the unpredictability of equine’s reaction to such things as sounds, sudden movement and unfamiliar objects, persons or other animals; certain hazards such as surface and subsurface conditions; collisions with other animals; the limited availability of emergency medical care; and the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within such participant’s ability.
Owner expressly releases Stable from any and all claims for personal injury or property damage, even if caused by negligence (if allowed by the laws of this State) by Stable or its representatives, agents or employees.
14. RIDER HELMET WARNING
I AGREE THAT: I for myself and on behalf of my child/legal ward have been fully warned by THIS STABLE that all horse handlers and riders should purchase and wear protective head gear which meets or exceeds the quality standards of SEI CERTIFIED ASTM STANDARD F1163 Equestrian Helmet while riding and being near horses and I do understand that the wearing of such head gear at these times may reduce severity of some of the wearer’s head injuries and possibly prevent the wearer’s death from happening as the result of a fall and other occurrences. THIS STABLE requires all riders to wear helmets while riding on the premises this also includes the mountain, riding ring and trails. Should you choose to not wear your helmet after signing this agreement and understanding that this is our policy, if you are injured, you will hold Double J Farm harmless and release THIS STABLE, its owners, agents, employees, officers, directors, representatives, assigns, members, owners of premises, affiliated organizations, insurers and other acting from liability for your actions.
15. DIRECT LOSS TO PERSONAL PROPERTY WARNING
OWNER is hereby warned that while on THIS STABLE’S premises direct loss, damage, theft or injury to OWNER’S horse, tack equipment and trailer is not covered by THIS STABLE’S insurance. The actual OWNER having financial interest in such items must carry his own personal property insurance under a homeowner’s, tenant or other insurance policy or under a separate policy as in the case of the loss of a horse. We do welcome locked tack boxes. Owner may store certain tack and equipment on the premises of Stable at no additional charge to Owner. However, vehicles stored upon the premises will be subject to a $10.00/day storage cost for all delinquent accounts.
16. RIGHT OF LIEN
The Owner is put on notice that Stable has a right of lien as set forth in the laws of the State of North Carolina, for the amount due for the board and keep of such horse(s), and also for storage and services, and shall have the right, without process of law, to retain said horse(s) until the amount of said indebtedness is discharged. However, Stable will not be obligated to retain and/or maintain the horse(s) in question in the event the amount of the bill exceeds the anticipated unregistered value of the horse(s). In the event Stable exercises Stable's lien rights as above-described for non-payment, this Agreement shall constitute a Bill of Sale and authorization to process transfer applications from any breed registration as may be applicable to said horse(s) upon affidavit by Stable's representatives setting forth the material facts of the default and foreclosure as well as Stable's compliance with foreclosure procedures as required by law. In the event collection of this account is turned over to an attorney, Owner agrees to pay all attorney's fees, costs, and other related expenses for which a minimum charge of $250.00 will be assessed.
17. HORSE CARE INFORMATION
Feed- Double J Farm feeds good quality feed and hay. If you choose to have a different type of feed fed to your horse. The difference of the cost of feed that we buy will be charged to the owners account. If feed is stocked locally in Burlington there will be no charge to pick up feed. All feeds that are stocked out side of Burlington will be charged $0.58 per mile to pick up feeds.
Our feeding schedules are as follows. In the summer (May- Mid October) we usually feed once daily to horses that are generally healthy, and without foal. Horses that are bred, or colts may be fed twice daily. We reduce the feeding due to the energy and protein that the horses are ingesting from the rich grass in the pastures. Stalled horses are given flakes of hay when they are stalled to ensure enough forage. Winter Months (Mid October- April) we feed twice daily with flakes of hay given while in stalls.
Farrier Information- We have the farrier out to the farm about every six to eight weeks to shoe and trim the horses. I will call the owner two weeks in advance to ask what they would like the farrier to complete on their horse. If the owner will be unable to attend the appointment or farm staff will be assisting, the owner will then be responsible for sending the check with correct amount by mail to Double J Farm. We will then give the check to the farrier at time of appointment.
Owner agrees to provide the necessary shoeing and worming of the horse(s) as is reasonably necessary, at Owner's expense. Owner agrees to provide Stable with all health records with regard to the horse(s). Owner agrees to have the horse(s) wormed and vaccinated on a regular schedule, and in the event same is not accomplished and proof of same presented to Stable within thirty (30) days from the date of such services or veterinary treatment, Stable is authorized to arrange for such treatment, but not obligated to do so; such expense shall be the obligation of Owner, and upon presentation by Stable of the bill for such services rendered, including service charges, any bill shall be paid within fifteen (15) days from the date the bill is submitted to the Owner.
Veterinarian Information- Our vet comes to our farm every August to update coggins and vaccinations. Our vet is willing to give discounts on the farm call to the owners, if there will be more than one horse vaccinated at the barn. If you show and you would like the horse to have spring and fall boosters, that can be arranged. You may use you own vet or ours.
Deworming- Double J Farm is on a rotational Deworming program every two months. All Deworming will be billed to the owner as cost plus tax. If the owner would like the horse to be on a daily deworming, this will be billed to the owner's account monthly. Would you, the owner, like your horse to be on a daily wormer, or bi-monthly worming? 19. ENTIRE AGREEMENT
This contract represents the entire agreement between the parties. No other agreements, promises, or representations, verbal or implied, are included herein unless specifically stated in this written agreement. This contract is made and entered into in the State of North Carolina, and shall be enforced and interpreted in accordance with the laws of said State.
20. ADDITIONAL AGREEMENTS
Additional agreements should be individually initiated by each party. If none, check this box.
21. ENFORCEABILITY OF CONTRACT
In the event one or more parts of this contract are found to be unenforceable or illegal, the other portions hereof shall be deemed in full force and effect.
ALL OWNERS AND PARENTS OR LEGAL GUARDIANS OR AUTHORIZED AGENT FOR SUCH PARTIES MUST SIGN BELOW AFTER READING THIS ENTIRE DOCUMENT. BOTH SPOUSES/OWNERS MUST SIGN FOR THEMSELVES.
